General Provisions

1.1. Products can be purchased in the online store labo.ee by the Buyer after registering in the online store – by entering the requested information during registration;
1.2. When ordering products, the Buyer must provide the necessary personal information to the Seller to fulfill the order: first name, last name, delivery address, phone number, and email address.
1.3. By agreeing to these terms, the Buyer agrees that the personal data provided in section 2.2 will be processed for the purpose of fulfilling purchase-sale agreements of products and services in the online store, for analyzing the Seller's activities (Google Analytics), and for direct marketing purposes. 
1.4. "Personal data" also includes information collected by Biofarmaatsia OÜ – website visits, various social media channels, and the use of our services.
1.5. Direct marketing content may be sent to customers by email and SMS only if prior consent has been obtained from the customer. 
1.6. The contact details provided by the Buyer, as well as the purchase history, may be used for automatic offers or discounts unless the Buyer objects. The Buyer has the right to unsubscribe from receiving such notifications at any time by writing to estonia@labo-baltic.eu.
1.7. The Buyer has the right to request the restriction of their personal data processing if there is a basis for it.
1.8. The Buyer who has registered in the online store and placed an order is obliged to keep the login details and not disclose them to third parties.
1.9. 1.9. By using the Biofarmaatsia OÜ website, you agree to the use of cookies and the personal data processing terms outlined in our Terms and Conditions.
1.10. From the Seller's marketing channels (including the website and social media), we collect data on the performance and usability of the channels. Additionally, we collect data when possible to improve customer communication, better understand the actual interests and goals of customers, and provide higher quality service, more accurate information, and ensure (enhance) the usability of the Seller's website. 

2. Rights and Obligations of the Parties

2.1. The Buyer has the right to purchase goods from the online store labo.ee, following the terms and conditions set out in these Rules and the information provided in the online store.
2.2. If the information provided by the Buyer in the registration form changes, the Buyer is obligated to update it immediately.
2.3. The Buyer is obligated not to disclose their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller by email at estonia@labo-baltic.eu.
2.4. The Buyer using the online store labo.ee agrees to these purchase-sale rules and is obligated to follow them and comply with the laws of the Republic of Estonia.

3. Rights and Obligations of the Seller

3.1. The Seller is obligated to enable the Buyer to properly use the services offered by the online store labo.ee.
3.2. The Seller has the right to immediately and without warning limit or suspend the Buyer's ability to use the online store or, in exceptional cases, delete the Buyer's registration if the Buyer attempts to damage the stability or security of the Seller's online store or breaches their obligations.
3.3. The Seller is obligated to respect the Buyer's right to privacy concerning their personal information provided in the online store labo.ee registration form.
3.4. The Seller is obligated to deliver the goods ordered by the Buyer to the pick-up point selected by the Buyer.

4. Ordering Goods, Prices, Payment Process, and Payment Methods

4.1. The prices of products sold on the website are displayed next to the products.
4.2. Product information is provided on the website directly next to the product.
4.3. The prices of goods in the online store labo.ee and in the order placed are indicated in euros, including VAT.
4.4. To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in, and the appropriate delivery method for the products must be selected. Then, the total amount due will be displayed, which can be paid securely through the following payment methods:

  • Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay
  • Pay later solutions: Liisi ID

NB! When paying via bank link, make sure to click on the “Back to Merchant” button on the bank’s page.

4.5. Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – when paying by bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The Seller does not have access to the customer’s bank and credit card information. The contract becomes effective when the payment amount is received in the Online Store’s settlement account.
4.6. The Online Store owner is the responsible data processor and will transmit the necessary personal data to Maksekeskus AS, the authorized processor, to perform the payments.
4.7. If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the Buyer will be notified as soon as possible, and the paid money (including delivery costs) will be refunded without delay, but no later than 14 days from the notification.

5. Delivery of Goods

5.1. The Buyer is obligated to provide an accurate address when placing the order. The package will be sent to the nearest Itella Smartpost parcel machine as per the address provided in the order. If the Buyer provides an incorrect address and the parcel is returned to the Seller, the parcel will be sent again only if the Buyer covers the shipping costs.
5.2. The Buyer is obligated to personally accept the goods. The Buyer does not have the right to submit complaints to the Seller regarding delivery to the wrong person.
5.3. The Seller is released from responsibility for delivery issues if the goods are not delivered or delivered at the wrong time due to the Buyer's fault or circumstances not dependent on the Seller.
5.4. The Buyer must immediately notify the Seller if the parcel is delivered in a damaged or crumpled package, if there are products that were not ordered, or if the quantity is incorrect, or if the product set is incomplete.
5.5. If the Buyer notices damage to the package during delivery, they are obligated to note it on the courier's delivery document or create a separate report about the damage. If these actions are not taken, the Seller is released from responsibility for the damage to the packaging.

5.6. Goods are shipped to the following countries: Estonia

5.7. The Buyer has the following options for receiving goods: Itella Smartpost

5.8. Shipping costs are borne by the Buyer, and the corresponding price information is displayed next to the shipping method. Delivery is FREE for orders over 50 EUR.

5.9. Domestic shipments in Estonia usually reach the Buyer's specified destination within 5 business days from the conclusion of the sales contract. In exceptional cases, the goods can be delivered within 45 calendar days.

6. Right of Withdrawal

6.1. After receiving the order, the Buyer has the right to withdraw from the contract within 14 days.
6.2. The right of withdrawal does not apply if the Buyer is a legal entity.
6.3. To use the 14-day right of return, the ordered goods must not be used in any way other than necessary to verify the nature, properties, and functioning of the goods, as permitted in a physical store.
6.4. If the goods have been used for purposes other than verifying their nature, properties, and functioning, or show signs of use or wear, the online store has the right to reduce the refund based on the decrease in the value of the goods.
6.5. To return the goods, the Buyer must submit a withdrawal statement, including:
the order number, name, the product(s) to be returned, and the reason for the return, to the email address estonia@labo-baltic.eu within 14 business days of receiving the goods.

6.6. The return shipping costs are borne by the Buyer unless the return is due to the product not matching the order (e.g., incorrect or defective product).
6.7. The Buyer must return the goods within 14 days of submitting the withdrawal statement or provide proof that the goods have been handed over to the carrier within this period.
6.8. The online store will refund the Buyer for the returned goods immediately upon receipt, but no later than 14 days after receiving the withdrawal notice, including any fees paid by the Buyer under the contract.
6.9. The online store may refuse to make refunds until it receives the goods subject to the contract or until the Buyer provides evidence that the goods have been sent back, whichever occurs first.
6.10. If the Buyer explicitly chooses a delivery method that is different from the cheapest standard delivery offered by the Online Store, the Online Store is not required to reimburse the Buyer for the additional cost incurred by the chosen delivery method.
6.11. The Online Store has the right to withdraw from the sales agreement and demand the return of goods if the price of the goods in the online store was mistakenly listed significantly below the market value of the goods.

Responsibility of the Buyer and Seller

7.1. The Buyer is fully responsible for the accuracy of the personal documents they provide. If the Buyer provides inaccurate personal data in the registration form, the Seller is not responsible for related issues and has the right to demand compensation for direct costs from the Buyer.
7.2. The Buyer is responsible for actions performed using this online store.
7.3. The registered Buyer is responsible for sharing their login details with third parties. If a third party uses the online store with the Buyer’s login details, the Seller will consider that person as the Buyer.
7.4. The Seller is released from all responsibility if damages occur due to the Buyer failing to review the terms and conditions of these Rules, even though they had the opportunity.
7.5. If damage is caused, the responsible Party must compensate the other Party for direct damages.

8. General Information

8.1. The Seller may, at their discretion, offer various promotions in the online store labo.ee.
8.2. The Seller has the right to unilaterally change the terms and conditions of promotions or cancel them, with any changes or cancellations taking effect at the time they are made.
8.3. The Seller will send all notifications to the contact details provided by the Buyer in the registration form.
8.4. The Buyer must submit all notifications and inquiries regarding the Seller’s online store labo.ee to the contact details provided under "Contact" on the website.
8.5. The Seller is not responsible for the Buyer not receiving notifications due to disruptions in internet services or email providers.

9. Technical Data

9.1. In managing the website and the labo.ee server, we may use the IP addresses of visitors' computers. We may use cookies and store browsing history data on the labo.ee website.

10. Data Protection

10.1. Biofarmaatsia OÜ takes all possible measures to protect the data of labo.ee visitors. We have implemented protective measures for the personal data we collect and process. 
10.2. We ensure access to data based only on applicable laws.

11. Dispute Resolution

11.1. If the Buyer has any complaints regarding labo.ee, they must be sent to the email address: estonia@labo-baltic.eu.
